Appealing an IRS Business Audit in Utah

You may have the right to appeal an IRS Business Audit. Contact Utah Business Tax Lawyer Michelle Turpin P.C. today to protect your business's interests.

Your Right to Appeal

When the IRS proposes adjustments to your business tax return following an audit, you have the right to disagree and appeal those adjustments. The IRS appeals process provides an independent review of your case by an Appeals Officer who was not involved in the original examination.

You generally have 30 days from the date of the IRS's examination report to request an appeals conference. If you miss this deadline, you may still have rights but the process becomes more complicated and expensive.

The IRS Office of Appeals

The IRS Office of Appeals is separate from the compliance functions that conducted your audit. Appeals Officers are trained to evaluate what both sides might win or lose in court, and they have authority to settle cases based on these "hazards of litigation" — meaning they can accept less than the full amount proposed by the examiner if there is genuine legal uncertainty.

Why Business Appeals Require Experienced Counsel

Business tax appeals are complex. They typically involve multiple issues, large dollar amounts, and require detailed legal and factual presentations. An experienced tax attorney can:

  • Identify the strongest arguments for appeal
  • Prepare a comprehensive written protest documenting your position
  • Present your case effectively at the appeals conference
  • Negotiate settlements that reflect the true hazards of litigation
  • Advise on whether Tax Court litigation is appropriate if appeals fails
