Types of IRS Appeals We Handle
Examination (Audit) Appeals
When you disagree with the findings of an IRS audit, you have the right to appeal to the IRS Office of Appeals. You typically have 30 days from the date of the examination report to request an appeals conference. If no agreement is reached, you can further appeal to U.S. Tax Court or federal district court.
Collection Due Process (CDP) Appeals
When the IRS issues a Notice of Federal Tax Lien or Final Notice of Intent to Levy, you have 30 days to request a CDP hearing with the Office of Appeals. This independent review can result in withdrawal of the lien, release of the levy, or negotiation of alternative collection arrangements.
Offer in Compromise Appeals
If your Offer in Compromise is rejected, you generally have 30 days from the rejection letter to request an appeal. Appeals Officers review OIC rejections independently and can accept offers that the original reviewer denied.
Penalty Abatement Appeals
When you disagree with IRS penalty assessments, you can request abatement and, if denied, appeal through the Office of Appeals. A well-prepared penalty appeal can result in significant reductions.
The IRS Office of Appeals & Hazards of Litigation
The IRS Office of Appeals operates independently from the compliance functions that handled your original case. Appeals Officers evaluate cases based on the "hazards of litigation" — meaning they consider what the IRS would likely win or lose if the case went to court. This creates genuine opportunities for settlement that simply do not exist at the examination level.
